Q&A

Abreu asks about poor building management and AEP eligibility

New York City Council · Aug 11, 2026 · starts 0:08:56 · 1 min 2 sec

Abreu asks about owners with long records of poor management and those in the city's Alternative Enforcement Program. Lee says DOF is in constant communication with sister agencies and only DOF-docketed OATH violations are eligible for the program.

Shaun Abreu

And what if they are owners who have a long record of poor building management?

Richard Lee

Of poor building management?

Richard Lee

That's something we'll discuss with DOB as we roll out the program.

Richard Lee

We are in constant communication with all of our agencies throughout this process and as we start beginning the rollout of this embassy program.

Shaun Abreu

Would you do the same as well with buildings related?

Shaun Abreu

To the city's AEP or other enforcement programs?

Richard Lee

Right now, AEP at its alternative enforcement program.

Richard Lee

Correct.

Richard Lee

We are in constant communication with our sister agencies on the rollout of this program, and so we are going to be working with them to determine which one of the programs will be viable.

Richard Lee

It's only for DOF ECB docketed violations, right?

Richard Lee

So that's what it comes down to.

Richard Lee

If it's an ECB docketed violation, it should be eligible for the program.

Richard Lee

If it is a docketed ECB violation and any other agency, it won't necessarily be part of this program.

Richard Lee

We are only looking at DOF docketed violations from Oath.
