Q&A on outdoor dining inspection burdens and health inspector timing

New York City Council · Aug 13, 2026 · starts 1:56:02 · 1 min 11 sec

A reporter raises concerns about restaurants facing frequent inspections with rulers during construction. Menin says the bills don't address this but the Council is open to looking into it, and also notes concerns about health inspectors arriving during busy lunch service.

Member of the Public

Henry Ross, can we go back to the conversation about streamlining outdoor dining?

Member of the Public

Does that also apply to when inspectors go out?

Member of the Public

And let me explain what I mean.

Member of the Public

I was just with a restaurant that went through the very cumbersome process of getting

Member of the Public

roadway dining area and they say they see inspectors all the time literally coming out with rulers and stopping their work and getting into it does the bill streamline any of that sort of regulation because they say that's getting

Member of the Public

really over the top for them

Julie Menin

Yeah, the bills do not address that issue, but we're certainly happy to look at it.

Julie Menin

That was not something that came up, and we've had so many hearings, so many meetings.

Julie Menin

That is not particularly a complaint that we heard, but we're certainly happy to look into it.

Julie Menin

And obviously anything that is becoming burdensome and cumbersome, we don't want to do.

Julie Menin

We also, quite frankly, I think, need to look at the fact that inspectors are constantly coming from the health department during service.

Julie Menin

So when you are having a busy lunch service, that is oftentimes when the health inspector will come, and that really puts an enormous burden on the restaurant.

Julie Menin

So for things, you know, whether they're measuring things, doing things, that's taking people away from their busiest time of service.

Council Staff

Thank you.

Any on-topic questions?

Julie Menin

I think.
