CM Cabán on FID misconduct data and PoliceStat law compliance
Cabán asks how many times FID has substantiated misconduct for officers who killed civilians since 2014, and raises NYPD non-compliance with the 2020 PoliceStat law requiring reporting of deaths by police. Gerber says NYPD provides certain data to DCJS and offers to discuss specifics offline.
In terms of officer misconduct, can either of you tell me how many times the FID has substantiated misconduct of officers who killed civilians since 2014?
We certainly do not have that data here.
We're certainly, we can get back to you in terms of that data.
I will say, I will say that certainly I know of instances where FID finds that use of force by officers was not within guidelines.
That definitely happens.
I know that for a fact.
I want to ask my last question.
I will wait for you guys to send the answer on the murdered civilians.
So on...
Actually, now I want to ask about the police stat law, that 2020 New York State legislation.
The police stat law, the 2020 state legislation.
Okay.
So that requires the police department to report on the number of people killed by police and number of people who die in police custody.
And in the six years since the passage of the police stat law, the NYPD has not reported the number of deaths to the state, and it's been out of compliance with the law.
So why is NYP out of compliance with this law, and when do you plan to correct this and get into compliance?
So, Councilmember, I am generally aware of the law, and we certainly provide data to DCJS in connection with that law.
Now, to the extent there are, if you are falling short in certain ways, I'm actually, maybe we can talk offline so I can understand better what you're referring to.
We 100% provide certain data sets to DCJS in connection with that statute.
Okay, well then we probably should connect because the information
here is that you guys are not in compliance with that law.
So, and to the extent there's a question about any one particular data set or giving some and not all, happy to discuss that.
I just want to be clear, as a writ large, we have reporting obligations and we certainly provide certain data sets to DCJS in connection.
Right, and writ large, you have lots of reporting obligations.
One of them is to be in compliance with the police stat law passed by the state in 2020, and you currently are not in compliance.
So if you could follow up with why you have not been in compliance with that particular law and when you plan to get into compliance, that's the information I'm hoping for.
Thank you and thank you, Chair.
Thank you so much, Councilmember.
I see Councilmember Nurse stepped out, so we're going to go back with Councilmember Wong.
Thank you, Chair.
