Chair Encarnación asks about Department of Probation limitations
Chair Encarnación moves to the Department of Probation and asks when it will institute limits on immigration status in pre-sentencing investigation reports and who will confirm. Ali says DOP has already instituted the limits, communicated them to executive staff, and reinforced them in trainings.
Thank you.
So we are going to go into the Department of Probation now and questions around that.
When will the Department of Probation Institute limitations on inclusion of information about immigrant status in presenting investigation reports?
And how will those be confirmed and who will be responsible for confirming this?
DOP has already instituted these limitations.
Specifically, DOP communicated with executive staff outlining these limitations on including immigration status information in
pre-sentencing investigation reports, and they have reinforced both of this in their trainings in the academy and field trainings for probation officers that are assigned to investigations.
And were you involved in those?
Yes.
So as a member of the IRC, MOIA has worked on providing guidance on how to strengthen these protocols and others.
And just another point, I think we had mentioned this in our testimony, that we have established a regular process for the agency to submit reports under Local Law 228.
So our interactions with the agency continue in that regard as well.
Great.
