Q&A

Gennaro asks about Local Law 41 resiliency score rulemaking

New York City Council · Sep 30, 2026 · starts 1:24:55 · 1 min 43 sec

Gennaro asks whether DEP has worked with MOCEJ on climate resiliency guidelines and the minimum resilience score required by Local Law 41. Prabilski says MOCEJ leads the effort and DEP coordinates with them.

James F. Gennaro

Next question.

James F. Gennaro

In accordance with Local Law 41 of 2021, MOCEJ

James F. Gennaro

published climate resiliency guidelines for the design and construction of covered capital projects.

James F. Gennaro

That local law also requires MOC-EJ in consultation with other agencies to promulgate rules by December 31st of this year to establish a minimum resilience score

James F. Gennaro

by which covered projects must be measured.

James F. Gennaro

Have you worked with MOCEJ on the resiliency score metric?

James F. Gennaro

Have you consulted with them about their upcoming rulemaking?

James F. Gennaro

That is rulemaking on local of what?

James F. Gennaro

They didn't do the rulemaking for local of 41 yet?

James F. Gennaro

Oh, so Local 041 is like successive rounds of rulemaking.

James F. Gennaro

Okay.

James F. Gennaro

I'm not sure I understand the question, but do you?

Catherine Prabilski

Well, I can give you an answer on a portion of it.

Catherine Prabilski

How about that?

Catherine Prabilski

Right.

Catherine Prabilski

MOCEJ is leading on the CRDG, the Climate Resilience Design Guidelines, enactment for the local law requirements.

Catherine Prabilski

They're coordinating across all agencies and particularly within DEP for some of those resilience goals.

Catherine Prabilski

So, yes, we...

Catherine Prabilski

The agency coordinates with MOCEJ as they're leading on completing that requirement from the local law.

James F. Gennaro

Okay.
