Chair Abreu asks DCWP about re-inspection policy
Abreu asks about DCWP's policy of returning to businesses after violations, and DCWP describes their escalation process including re-inspections and sealing orders.
Yeah, let's have continued conversations on both sections, talking about what the offense should be for the first offense and the amounts.
That can be an active conversation.
That would be greatly appreciated.
When DCWP charges a business for a micromobility-related violation, do you have a policy of returning to the business some period?
Of time after the violation to see if they are in compliance.
I understand that Mr.
Ortiz says there's re-inspections that will be happening, but just curious to learn more about that policy.
Yeah, absolutely, and this speaks to the escalation
process I described earlier.
If we see violations, we're absolutely going to issue summons.
We're going to do re-inspections.
If we see recidivism, we will issue sealing orders, which we have done.
Some of these sealing orders we can pull back if the business then does come into compliance.
But what you've seen just in our most recent sweep, which was
I guess it's this month, September.
We found 53 businesses not in compliance.
13 came into compliance.
The other 40 we're going to be following up.
I would add to Chair that, or sorry, Majority Leader, that...
Both is fine.
You can just call me Carlos, too.
That, you know, when we encounter, if we go into business and we see a lot of Local Law 39 issues or conditions that reflect perhaps a fire safety issue, we will notify FDNY immediately.
And they also have sealing authority under the newest amendments of Local Law 39.
Relatedly, if we see a vast amount of motorized scooters, while we're not able to confiscate, we will notify the NYPD of the presence of motorized scooters so they can confiscate.
So again, that speaks to the coordination that has to happen between our agencies.
Thank you.
And Chief Obey, Commissioner Obey, I just want to apologize.
I think I pronounced your name Ebe earlier.
I meant to say Obey.
Councilmember Santosu also, followed by Hanif, and then we'll switch over to public testimony.
