Q&A

Chair Feliz follows up on vest law enforcement

New York City Council · Sep 30, 2026 · starts 2:37:16 · 3 min 14 sec

Feliz asks who is in charge of enforcing the vest law and what has been done to achieve compliance, and DOT and NYPD say they will look at training and enforcement.

Oswald J. Feliz

Thank you.

Oswald J. Feliz

Thank you so much, Chairs Abreu and Epstein.

Oswald J. Feliz

So two sets of questions, one related to enforcement at the street level and second at the enforcement at the point of sale.

Oswald J. Feliz

But before that, I just want to ask some follow-up questions to the

Oswald J. Feliz

the questions that our speaker asked about the laws that we passed in 2017 related to the vests and also the IDs that these drivers have to carry.

Oswald J. Feliz

So who is in charge of enforcing this law?

Oswald J. Feliz

Is it DOT and DCWP?

Unidentified speaker

So DOT is able to enforce, it's also in NYPD's code, so I believe they are also two folks, but I'll defer to our colleagues at NYPD to speak more on that.

Unidentified speaker

Right, so there's the street level piece, and then there's the corporate piece, the corporate regulatory piece.

Unidentified speaker

You know, the corporate regulatory piece is really much more sort of for DOT.

Unidentified speaker

It's not something that a patrol officer is going to do in terms of on the, you know, summonsing on the employer side.

Unidentified speaker

With regard to the street-level enforcement, as I said earlier in response to the speaker's question, we're going to take that back and look very carefully at that in terms of the training that we're giving to the officers.

Oswald J. Feliz

All right, so you're going to look at the training given to the officers.

Oswald J. Feliz

What, if anything, though, has DLT or any of the administration done so far to get us to compliance with that rule?

Unidentified speaker

So I know that this has been an issue over the course of several administrations.

Unidentified speaker

So the introduction of the law early on over a decade ago started, I think, from a place where we're in a very different economy and use of our streets than we are today in terms of the devices and the companies that are out there.

Unidentified speaker

So for the most part, at that time, DOT was enforcing at brick-and-mortar locations with sort of dedicated employee delivery workers and couriers.

Unidentified speaker

Obviously, the landscape of the city has changed quite a bit since the original introduction of the bill.

Unidentified speaker

Across the last two administrations, the Department of Transportation has sent letters about lack of compliance to the third-party delivery companies that are licensed by DCWP today and have been

Unidentified speaker

rebuffed on those in the past in terms of formal compliance.

Unidentified speaker

That is why it is so important to tighten up these laws in the proposed legislation, as well as other legislation that has passed recently affecting the CBL.

Oswald J. Feliz

How long does the administration think it'll take to get us to full compliance with that rule, or at least fair compliance?

Unidentified speaker

I think we'll need to have discussions with our partners and take a closer look at it.

Oswald J. Feliz

What steps do you think we have to take to get us to a good amount of compliance with that rule?

Oswald J. Feliz

Do you think we'll be able to make progress in six months?

Unidentified speaker

The joint staff of DCWP and DOT in our conversations regularly with the app companies have given them, I believe, a March 2027 timeline to be in full compliance.

Oswald J. Feliz

Okay.
