Commissioner Flynn addresses consumer confusion and illegal devices
Flynn says the evolving market leaves riders confused about legal vs. illegal devices, and notes DOT issued cease and desist letters to 42 retailers selling illegal e-bikes online.
One challenge is that the evolving market of micromobility devices often leaves riders and consumers confused.
It's difficult for consumers to know the difference between legal e-bikes, illegal e-bikes, mopeds, motorcycles, etc.
The law includes three classes of e-bikes right now.
Two of them have max speeds of 20 miles per hour, and the third has a max speed of 25 miles per hour.
Any e-bike that goes above these speeds is illegal, yet many consumers are misled by deceptive marketing practices by retailers who advertise and sell illegal products.
This is why we recently joined Mayor Mondani to issue a cease and desist letter to 42 retailers found to be selling illegal e-bikes to New Yorkers online.
