Commissioner Levine testifies on pre-considered 2361 (banning Class 3 use)
Levine shares the goal of removing unsafe devices but has significant concerns about unintended consequences for delivery workers, including loss of livelihood.
Turning now to pre-considered bill 2026-2361, this would prohibit the operation of class 3 e-bikes and require the violators receive a warning for the first violations and escalating civil penalties for subsequent violations.
We share council's goal to rid our streets of unsafe micromobility devices.
However, we have significant concerns of unintended consequences that would most heavily impact delivery workers, many of whom are immigrants with limited English proficiency and other vulnerabilities.
Delivery workers could face losing their livelihoods as well as increased interactions with law enforcement at a time when many are especially fearful of such interactions.
And could also lead to confiscation of the device they use every day to earn a living.
We look forward to a
working with the council to improve street safety while balancing the needs of some of our city's most essential yet vulnerable workers.
