Q&A

Shulman questions applicant on Fontaine and as-of-right massing

New York City Council · Oct 6, 2026 · starts 1:02:28 · 1 min 4 sec

Shulman asks whether as-of-right construction could be built right on top of the Fontaine and whether the proposal would be farther away; Siegel confirms as-of-right would be about 20 feet away and the proposal would be farther.

Farah N. Louis

Councilmember Shulman?

Lynn C. Schulman

Thank you.

Lynn C. Schulman

I want to talk a little bit about the Fontaine.

Lynn C. Schulman

So my understanding from your testimony is that if you would have built it as of right, in other words, you didn't have to come to the city council, you would have permission to build right on top of the Fontaine.

Lynn C. Schulman

Is that correct?

Lynn C. Schulman

And that basically that under what you're proposing, you'd be farther away.

Lynn C. Schulman

Is that right?

Member of the Public - Jay Siegel

Correct, counsel.

Member of the Public - Jay Siegel

We couldn't be right on top.

Member of the Public - Jay Siegel

We'd be 20 feet away from them because they have a 19-foot, 7-inch gap between most of their building and their property line.

Lynn C. Schulman

I'm just asking so that people know as of right what that is and what you guys are proposing.

Lynn C. Schulman

And so, and I'm hoping that you guys come to an agreement.

Lynn C. Schulman

Because before anybody votes on this, that has to happen.

Lynn C. Schulman

Okay.
