Council Member Brooks-Powers Introduces Intro 1104 on Youth Rights in Probation Intake
Brooks-Powers introduces Intro 1104, requiring the Department of Probation to provide written notice and explain rights before intake interviews for youth accused of crimes.
I am proud to introduce two bills today concerning the Department of Probation.
The first, Intro 1104, would give youth accused of crimes clear information about the criminal legal process after a young person is arrested for an offense which can be heard in family court.
They and their family will often meet with the Department of Probation.
For an intake interview that can determine whether the case is resolved without court via adjustment or continues through the court system.
Because an attorney is generally not present during that intake interview, families frequently navigate this moment without counsel and may share information or sign paperwork without knowing the consequences.
This bill would require the department to provide a written notice before intake explaining the process and identifying organizations that provide legal representation to youth.
At the start of the interview, the department would also inform the youth and their family of their rights, including
how the information they share may be used and what signing any paperwork entails.
