Menin asks Kim about whistleblower rewards and NDAs
Menin explains the Council's whistleblower bill would provide financial rewards from penalties and asks Kim whether SpaceX AI used NDAs or confidentiality policies that restricted reporting safety concerns; Kim says all employees signed NDAs and that restriction was strongly implied.
Thank you both for your testimony.
testimony today.
I do have a number of questions.
So Mr.
Kim, you mentioned that one of the things that you really want to see is strong whistleblower protection.
So our bill, for example, has a financial reward for whistleblowers and gives the whistleblower a significant
portion of the financial penalties which can result in the multi-millions of dollars since it is
a per agent per instance penalty so if there are thousands of rogue agents or the product is being sold and marketed in New York to
tens of thousands of people, obviously these penalties will add up.
So I appreciate your comments on that.
Also, the idea of the protection for the whistleblowers, this is exactly why at our hearing last week, when we had Alex Turner here, we issued a friendly subpoena
so that he could freely testify.
So to that end, when you were employed by Space XAI, was there any nondisclosure or confidentiality policies that could be interpreted as restricting employees from reporting safety concerns?
I'm not a lawyer, but yes, all employees were required to sign an NDA on joining the company.
And were you ever instructed that if you were to speak out or raise certain safety concerns, that would be something that would violate the NDA?
Not explicitly, but I believe that was strongly implied in the way that the company was run.
