Wilson asks about landlord responsibilities and commercial tenant outreach
Wilson asks how DOHMH ensures landlords of commercial food spaces are partners in hygiene and food safety. Schiff says DOHMH's relationship is with the permit holder but some obligations, such as pest-free property conditions, fall on building owners, and the department may cross-refer to its pest control program.
When you do the inspections, there are certain elements of the building that's controlled by the restaurant and others that are by the landlord that rents the space to the commercial tenant.
What are some ways that the health department ensures that landlords of buildings...
Are active partners in maintaining hygiene and food safety, and how to ensure
make landlords aware of what their responsibilities are to commercial food tenants.
Our relationship is with the permit holder, so the person that owns that restaurant.
And certain of the requirements certainly have to do with facilities.
And so we would recommend that restaurant owners make sure that that lease and that relationship with the property owner is clear.
In some certain circumstances, they may need cooperation with the property owner to make corrections if they are.
Building related, for example.
But our relationship is with the restaurant owner.
So the department does not do any types of trainings or outreach to commercial landlords that have leases with commercial food tenants?
It might depend on what the issue is.
If there is a pest condition, as we were talking about before, some of those obligations are on the owner of the property.
So it may depend on exactly what the issue is.
So the owner of the property is responsible for maintaining that property in a pest-free state.
The restaurant would certainly be responsible for making sure that there are not...
Holes that allow the pests to move around their restaurant, whether there's an opportunity for our pest control program to intervene with that property manager, there may be, and sometimes we do that internal cross
reference that I was noting between our food safety program and our pest control program.
Okay, thank you.
