Anne Diebel opposes 561-A and suggests warning notices
Diebel says she is a private investigator who found the complaint program confusing but has seen it change truck behavior near PS 307. She suggests DEP send rapid warning notices with video links, as other agencies do.
Hello, good afternoon.
My name is Anne Diebel, and I'm a private investigator in Brooklyn.
I'm opposed to 561A.
I've filed fewer than a half a dozen complaints through the Citizen Complaint Program.
Although I have experience in using public records, gathering evidence, and so on, I still found the program difficult and confusing, so I decided to leave the complaints to others.
But I have followed the program since then and have noticed its effects where I live.
When I used to walk with my daughter next to the local elementary school, PS307, there were lines of dump trucks for days on end, on the entire time, for work on the Con Ed substation and the Navy Yard and for local condo excavation.
These days, if you so much as point a phone at them, they'll shut off.
And in fact, I've noticed they're often turned off from the get-go, even when the weather is bad.
The drivers in the same line now dress for the weather and use the site flaggers and WhatsApp groups to call up the trucks one by one instead of inching forward.
This is clearly the direct impact of the program, not just better air, but better operational efficiency.
It sounds like the program's biggest problem for all parties is processing time.
Other cities like San Bernardino and Reno, as well as departments within NYC,
like Landmarks Preservation and HPD, rapidly send respondents warnings without asserting that an actual violation has occurred.
There's no reason DEP can't be set up the same way.
Thank you.
