Chair asks about accountability penalties
Won asks what happens to vendors that fail to report. Harry says there is a penalty mechanism under the law and rules, but OCH prefers to work with employers first and can assess financial penalties for failure to make best efforts.
And for accountability for those who have failed to provide the reporting, what happens to those vendors?
Yeah, so there is a penalty mechanism under the law.
and under our rules.
With that being said, for true success of this program, we want to make sure that we are working with these employers and helping meet their needs and really so understanding what are their hiring needs and are they actually working with the public workforce system?
Are they working with referral sources?
Are they publishing these jobs and making them available and accessible to New Yorkers?
So that's core to it.
If in the case where vendors are failing to do that and failing to make best efforts, there is the ability for the city to assess financial penalties on these vendors for failing to do that.
And so we...
Intend to use that if we need to, but for many of these contracts, they're pretty early on in their process.
And so while we're monitoring on a constant basis, we know that hiring needs are not necessarily driven directly by the contract term.
And so we're not at the point yet where we have to do that, but we are prepared to do that if we need to.
