Chair Ung Q&A: Mangin on council legal authority and disregarding local concerns
Ung asks whether the Council has legal authority to require BSA transparency improvements and whether it's fair to disregard community concerns. Mangin commits to the improvements without needing legislation and says local voices are paramount even if not always decisive.
Do you believe, and since you're committing to it, but if somehow it doesn't happen, do you believe the council has legal authority to require the BSA to do that?
Thank you for the question.
I'm not totally sure.
I don't want to be answering legal questions that may implicate charter issues on the fly.
I commit to doing it.
And I'd have to get back to you on any of the legal questions.
Sure.
Let's hope we don't have to come down to that.
But thank you for the commitment.
With your understanding that you can't please everyone, would you agree it's fair, it isn't fair, to disregard the concerns of the affected communities as they perceive the impacts of new development coming into their neighborhood,
particularly with BSA approvals, because that would invariably mean that development would not be complying with existing zoning rules.
Thank you, Chair.
Yes, I mean, I believe that local voices are paramount when it comes to land use decisions.
That doesn't mean that they're always decisive, but I do hold them as paramount.
