Council Member Santosuosso questions on 32BJ agreement and appeals board

New York City Council · Sep 9, 2026 · starts 1:16:04 · 1 min 15 sec

Santosuosso asks about 32BJ negotiations. Grinshtein reports a neutrality agreement has been reached with 32BJ, with prevailing wage commitment. Santosuosso then asks about appeals board use if the council rejects the application.

Kayla Santosuosso

Something you mentioned earlier is that you were looking into the legal tools available to you should the council not support this rezoning application.

Daniel Grinchstein

Correct.

Kayla Santosuosso

So does that mean that if the council does not support the rezoning application that you would seek use of the appeals board, for instance?

Daniel Grinchstein

For instance, yes.

Daniel Grinchstein

And the appeals board is largely untested, but in the event that we received a negative

Daniel Grinchstein

reaction there, our second opportunity to get the project approved would be to file in January the same application.

Daniel Grinchstein

And to pursue an approval through ULURP under the new abbreviated timeframe.

Kayla Santosuosso

And, of course, that would bypass me and the council completely.

Daniel Grinchstein

That's correct.

Kayla Santosuosso

And in that case, would you be proposing a building at R7X or at R7D?

Kayla Santosuosso

It seems to me that you're now coming to the council and saying you're proposing it at an R7D.

Kayla Santosuosso

If you were to use these new tools, are you coming back with an R7X?

Daniel Grinchstein

We would most certainly come back with an R7X or perhaps even a greater R8 or R9 Sony designation.
