Chair Encarnación asks about detainer reporting standardization
Chair Encarnación asks whether NYPD and DOP will standardize detainer reporting by conviction status and terrorist screening database matches. Ali says yes, they will align with DOC, and quarterly detainer reports are now happening for NYPD, DOC, and DOP.
Now, the report also notes that NYPD and the Department of Probations are not currently required to disaggregate the number of civil immigration detainers lodged by conviction status
and or possible match in federal terrorist screening database, whereas DOC is required to do so.
I know the report recommends that these three agencies standardize their reportings.
So have NYPD and DOP agreed to adopt this recommendation?
So the NYPD and DOP will, the short answer is yes, and they will report on civil immigration detainers broken down by conviction status
and or possible match in a federal terrorist screening database.
And this already aligns with what DOC is currently doing.
And in the IRC's view, and you may not want to speak for it,
for the full IRC, but as a member of the IRC, or you may know, would this discrepancy require a legislative fix?
On that, I'll defer to the council regarding any future legislation, but the agencies here are in compliance.
Okay.
The report also states that NYPD, DOC, DOP are required to submit the quarterly detainer reports.
So that is happening, you said, right?
It is happening, and the guidance was issued to clarify and give clarity on the expectations to NYPD, DOC, DOP as well.
And all three agencies have agreed to the frequency of reporting.
These were annual reports that will now be quarterly.
Okay.
