Q&A

Chair Abreu asks why prior assessments weren't made public

New York City Council · Sep 30, 2026 · starts 1:39:11 · 1 min 38 sec

Abreu asks why the administration hasn't made prior assessments of illegal devices in fatalities public, and Flynn says they work to put crash data on open data and will look closer.

Shaun Abreu

Was this the first time that the administration had assessed whether the devices involved in these fatalities were illegal or not?

Madeline Labadee

We can speak to that.

Madeline Labadee

Thank you, Chair.

Madeline Labadee

No, I think that any time that there is a fatal crash, the methods by which NYPD and DOT work together on immediate response and investigation and then analysis for

Madeline Labadee

future street safety work shows that we're collecting a lot of information, including photo, video, and other information.

Madeline Labadee

DOT helps partner with NYPD's Chief of Transportation team to review the imagery from these more intense investigations and documentation to help assess the legality or illegality of a given device.

Madeline Labadee

So that can include reference the chart that we provided in our testimony, some of the pieces there of which category it may fall into based on its manufacturer and other information that the team supports with research.

Shaun Abreu

If this is not the first time that the administration had assessed whether the devices involved in these fatalities were illegal or not, why hasn't the administration made those prior assessments available to the public?

Mike Flynn

Yeah, so we work really hard and closely with PD to put a lot of crash data on open data.

Mike Flynn

I'd have to go look closer to see if this is on there, this level of detail, but it's something we're happy to take a closer look at.
