Commissioner Flynn testifies on Intro 988 (false advertising)
Flynn supports Intro 988 prohibiting misleading advertisements, but recommends expanding it to also prohibit advertising illegal devices as e-bikes.
Next, Intro 988, sponsored by Chair Abreu.
This bill would prohibit the advertisement of vehicles required to be registered with the Department of Motor Vehicles as powered bicycles or powered mobility devices.
We support this bill to prohibit misleading advertisements, but the current draft of the bill only targets the advertisement of legal devices, given that they must be registered with the DMV.
We think it's also important to expand the bill to also prohibit advertising illegal devices as e-bikes or other legal mobility devices, such as in the case of the most recent crash in front of One Center Street.
These illegal devices cannot be registered with the DMV and therefore would not be captured by the bill as drafted.
