De La Rosa asks about Minnesota law and liability for nonconsensual imagery
De La Rosa notes SpaceX challenged Minnesota's restrictions on AI tools enabling nonconsensual sexual imagery and asks where legal responsibility lies; Castillo-Madrid says SpaceX is not fighting a ban on nonconsensual deepfakes but opposes the law's reach to lawful content.
Your company has challenged in court Minnesota's restrictions on AI tools that enable non-consensual sexual imagery.
Where do you believe legal responsibility should lie when a user employs your model to create such material?
Is it with the user, the developer, or both?
And what obligations should developers have to prevent the misuse?
To be clear, we're not fighting a ban on non-consensual deepfakes.
Our own policies prohibit notifying real people's image without their consent.
Our concern with that specific law you cite is that the law extends to lawful content, and the Eighth Circuit agrees, and they temporarily blocked enforcement because of that.
