Samuel Eluto of BTEA seeks clearer operational-idling definitions

New York City Council · Oct 20, 2026 · starts 2:06:49 · 2 min 18 sec

Eluto says BTEA wants stronger definitions of operational idling and better evidence requirements. He says demolition, asbestos remediation, and other trades have equipment needs that current enforcement does not adequately recognize.

Member of the Public - Samuel Eluto

But thank you, Council Member Epstein and Chair Gennaro.

Member of the Public - Samuel Eluto

We're going to share recommendations.

James F. Gennaro

Yeah, could you say your name for the record, please?

Member of the Public - Samuel Eluto

Samuel Ludo, Director of Member Relations for the Building Trade Employers Association.

Member of the Public - Samuel Eluto

I know Council Member Epstein acknowledged that the process is currently flawed to give notice to our contractors, and that's a priority.

Member of the Public - Samuel Eluto

But another priority is really understanding the oath mechanism to have that deliberation, right?

Member of the Public - Samuel Eluto

There's been a discussion throughout this council hearing about what qualifies as idling, and we think that there should be stronger definitions, clarifications, enforcements, and also requirements for evidence because, you know, if our council...

Member of the Public - Samuel Eluto

If we get notice, there's still discrepancies about what should be considered operational idling.

Member of the Public - Samuel Eluto

And, you know, our members, 24 different associations, we have, you know, everything from decontamination units.

Member of the Public - Samuel Eluto

So, you know, when you're cleaning out asbestos, you need to have that kind of working, you know, engine running.

Member of the Public - Samuel Eluto

But even, you know, one of our members, the demolition contractors, in order to take all that garbage, you have to do things like compress it, which necessarily isn't captured in these other discussions about what is considered

Member of the Public - Samuel Eluto

operational idling, what is considered the regeneration process.

Member of the Public - Samuel Eluto

My understanding is it's a little bit different for demolition contractors or it's a little bit different for asbestos and remediation.

Member of the Public - Samuel Eluto

So, you know.

Member of the Public - Samuel Eluto

The bus guys have their own thing going on.

Member of the Public - Samuel Eluto

There's other things, but, you know, we're going to send very specific recommendations, which we think are, you know, we think there should be good, you know, environmental, you know, remediation and good environmental justice policies.

Member of the Public - Samuel Eluto

But we also think that our members shouldn't be unfairly targeted by policies.

Member of the Public - Samuel Eluto

Thank you.

James F. Gennaro

Thank you.

James F. Gennaro

Thank you.

James F. Gennaro

And, yeah, I appreciate that.

James F. Gennaro

BTEA, right?

Member of the Public - Elizabeth Crowley

Yep.

James F. Gennaro

BTEA, right.

James F. Gennaro

Okay.

James F. Gennaro

Thank you both.

James F. Gennaro

And, oh, here we go.

James F. Gennaro

Here we go.

James F. Gennaro

James F. Gennaro

Yeah.
