Joseph asks about criminal summonses and nuisance abatement cases
Joseph says developers treat fines as a slap on the wrist and asks how many criminal summonses DOB has issued and tried; Tigani says DOB is exploring more aggressive use of criminal summonses and nuisance abatements with the Law Department, and Shamash reports 71 criminal court summonses issued this year versus 36 in 2025.
We are exploring, we have in the past, and we're exploring if we can, there's more aggressive use of criminal summonses and nuisance abatements, which is legal actions that we do in coordination with the law department.
They can be very difficult cases to bring forward and try.
How many have you tried this year?
How many have you issued and how many have you tried?
I think we can look up those numbers for you.
That would be great.
This year, so far, we've issued 71 criminal court summonses.
So as the commissioner mentioned, we are using that tool more and more.
Thanks in part to the additional staffing we received as a result of the proactive enforcement program we were discussing earlier.
That's compared to 36 in calendar year 2025.
How many of them were ever dismissed through the office?
I mean, this would be separate.
This is oaths being a different...
jurisdiction versus us going to Supreme Court with our criminal summonses and nuisance abatements.
Okay.
Thank you, Chair.
Thank you so much, Councilmember Joseph.
And, yeah, just to echo the frustration, it's something that I face too.
I've had, and this is anecdotal, but, you know, properties that have gone up completely that neighbors will say the whole thing was done, there was never paperwork put up, and nobody ever came.
I mean, and then did they call 311?
That was a question.
But there's just a lot of work that happens, especially in the smaller projects, right, in the smaller sites that...
There's a lot of concern around echoing that.
Thank you.
