Q&A

Williams asks about DA information requests and ACS lists

New York City Council · Oct 27, 2026 · starts 1:40:28 · 2 min 27 sec

Williams asks about the DA's testimony that prosecutors are not getting information. Ginsberg says the Bronx DA requested a list in July and was provided one, Brooklyn requested multiple lists and received them, and ACS has never received a request for a daily census.

Jumaane Williams

Also, the DA's mentioned information that they are saying that they're not getting.

Jumaane Williams

Are you aware of that?

Jumaane Williams

Is that new or is that something that's longstanding?

Nancy Ginsberg

So we received a request from the Bronx DA's office in July for a list of young people who are in our custody.

Nancy Ginsberg

We provided that list and we never received another request from them.

Nancy Ginsberg

We have received multiple requests from the Brooklyn DA's office.

Nancy Ginsberg

We have provided multiple lists to the Brooklyn DA's office.

Nancy Ginsberg

When we first got the request, we had to go to OCFS, which is our oversight agency, the state oversight agency, to ask for permission to release that information.

Nancy Ginsberg

Once we were provided permission, we provided the information to the DA's offices.

Nancy Ginsberg

We have never received a request for a daily census.

Rebecca Jones Gaston

I would just add that the importance of collaboration is absolutely critical in this.

Rebecca Jones Gaston

And you heard from DA Clark some of the constraints legally in regards to what we can and cannot share.

Rebecca Jones Gaston

But our commitment is to obviously go through the process that DC.

Rebecca Jones Gaston

Ginsburg identified related to our state partners in the oversight body when there are requests.

Rebecca Jones Gaston

There are also reports that do go to the DA's office upon request related to court.

Rebecca Jones Gaston

Thank you.

Jumaane Williams

Just something clear based on the answer.

Jumaane Williams

You're not aware of outstanding requests that were made?

Nancy Ginsberg

Correct.

Nancy Ginsberg

As far as the reports about how young people are doing in detention, we regularly provide what we call adjustment reports.

Nancy Ginsberg

Oh, I'm sorry.

Nancy Ginsberg

The judges can order, the judges in the youth part or in family court can order adjustment reports and we provide information for court dates upon those orders.

Nancy Ginsberg

And so if there is a request for information about how a young person in custody is doing, a request can be made for that adjustment report and it is produced to the court for the adjourned date.

Jumaane Williams

Okay, thank you.
