Q&A

Abreu asks about expanding DOT enforcement authority and towing

New York City Council · Oct 27, 2026 · starts 0:49:19 · 2 min 17 sec

Abreu asks whether DOT's authority could expand for certain traffic violations or crash investigations and whether towing capacity is sufficient. Flynn says DOT thinks creatively about enforcement and automated enforcement, and says towing capacity is sufficient but DOT wants to replace the lost Manhattan tow pound.

Shaun Abreu

I'm going to go ask a question on enforcement coordination now between the agencies.

Shaun Abreu

NYPD remains primarily responsible for enforcing moving violations while DOT oversees street design and much of the city's automated enforcement infrastructure.

Shaun Abreu

Has the administration considered expanding DOT's authority to enforce certain traffic violations or investigate serious crashes?

Mike Flynn

Well, what I can say, Chair, is, you know, I think hopefully it's evident in the Vision Zero reimagined plan that we're always trying to think creatively about all aspects of Vision Zero, enforcement being one of them.

Mike Flynn

We're really proud of the impact of the automated enforcement program, and we're giving a lot of thought to that as well.

Mike Flynn

With the state legislative session ahead of us.

Mike Flynn

And on manual enforcement, we collaborate really closely and really well with PD, as you just heard.

Shaun Abreu

What about towing capacity to enforce parking laws?

Shaun Abreu

Does DOT or NYPD need increased capacity?

Mike Flynn

I can say, maybe not specifically the parking laws, but just for what it's worth, when we're redesigning a street or repaving a street, we do have the capability at DOT to tow vehicles out of the way.

Mike Flynn

I would defer to my colleagues at PD on that.

Shaun Abreu

Do you need more towing capacity to get cars off the road?

Mike Flynn

The towing capacity we have right now is sufficient for our enforcement goals.

Mike Flynn

And as you know, Chair, we had a tow pound in Manhattan that we lost several years ago because of a change in state law.

Mike Flynn

We've been working to try to find a replacement location.

Mike Flynn

That's a difficult thing to do, obviously, in Manhattan, given Manhattan real estate.

Mike Flynn

It's something we're working actively towards.

Mike Flynn

But with what we have now, we're able to do the work.

Shaun Abreu

Are there any responsibilities that could be transferred from PD to DLT or vice versa?

Shaun Abreu

So when it comes to towing capacity that y'all have spoken about,

Mike Flynn

I can't say we've had those conversations.

Shaun Abreu

All right, I have questions on...

Shaun Abreu

What is the coordination?

Shaun Abreu

Wait, actually.
