Chair Hudson questions DHS on subcontractor termination authority
Hudson asks about provider subcontracts and termination. Fellini says providers manage subcontracts, DSS ACCO approves, and DHS can recommend termination. Dalton says DHS can terminate primary contracts, not subcontracts.
Specific to security or food vendors or maintenance contracts, our nonprofits have the ability to decide to contract that work out.
They do their market research.
Get bids from interested vendors and go with the lowest bidder who's able to be responsive to the ask.
The provider is responsible for managing that contract.
DSS ACCO approves the subcontract, but the provider is ultimately responsible for implementing and making sure that the contractor is meeting the requirements of the subcontract.
Okay.
And do you all have the authority to terminate a contract at any point in time?
Let's just to clarify, sorry, now I'm asking questions myself, but we have authority to terminate contracts with our primary contractor.
Yes, contracts.
But not necessarily with the subcontractor.
That's correct.
I'm reading Christine's.
Yes.
That relationship is between the provider and the subcontractor.
We can recommend.
You could recommend, and then if they are...
If they choose not to terminate based on your recommendation, when is the next, when would be the first opportunity for you all to then engage or is there no opportunity for you to engage at all with a subcontractor?
Because I would assume that once that subcontract reaches the end of its term,
then perhaps you all could insert yourselves and say we don't want to.
Okay.
We're checking.
We'll have to get back to you on that.
Okay.
Great.
Thanks.
