Councilmember Cabán presses NYPD on DAT denial data and broken windows policing

New York City Council · Jun 25, 2026 · starts 1:50:20 · 1 min 52 sec

Cabán argues DAT policy is central to court efficiency and jail population, citing data that over 90% of the time NYPD finds reasons to avoid field DATs, often citing open summons warrants. The NYPD representative says he will follow up with data.

Tiffany L. Cabán

the efficiency of the courts and in reducing the jail population.

Tiffany L. Cabán

You know, you can't get into jail without.

Tiffany L. Cabán

An arrest being precipitous.

Tiffany L. Cabán

So I don't know why you're not able to testify on that.

Member of the Public - NYPD Representative

Sure.

Member of the Public - NYPD Representative

And I'll be more than happy to follow up with you with respect to the reasoning and that question.

Member of the Public - NYPD Representative

And I'll try to get you data on reasons why.

Tiffany L. Cabán

Okay.

Member of the Public - NYPD Representative

DATs are being disqualified.

Member of the Public - NYPD Representative

If we're able to capture that metric, I would have to check that.

Tiffany L. Cabán

And just as a reminder from the testimony from the executive budget hearing around this, the court decision at the state level.

Tiffany L. Cabán

Says when a D.A.

Tiffany L. Cabán

or an appearance ticket must be given in the field.

Tiffany L. Cabán

And well over 90% of the time, the NYPD is finding a reason or just flouting the law and taking people to the precinct to process them there.

Tiffany L. Cabán

And it's causing a lot of problems.

Tiffany L. Cabán

It's not just backing up the system, but also we're seeing really devastating things happen to the people while they're in police custody.

Tiffany L. Cabán

And the reason that was given was that there are other open warrants, but what...

Tiffany L. Cabán

Failed to be disclosed is the data around how many times those open warrants were for the same kind of nonsense, where

Tiffany L. Cabán

those open warrants were actually SAP warrants, right, where summons warrants is for taking up an extra seat on the subway, for having an open container, things that should not justify

Tiffany L. Cabán

somebody being processed and, quite frankly, categorizing them as, like, we had to process them because they had these open warrants, amounts to misleading fear-mongering.

Tiffany L. Cabán

So I would like the data on that.

Tiffany L. Cabán

Can you tell me the most common reason why an otherwise eligible DAT is denied?

Member of the Public - NYPD Representative

Again, I'm going to have to get back to you on that.

Tiffany L. Cabán

Okay.
