Q&A

Morano asks who is responsible for determining whether records were lost

New York City Council · Sep 22, 2026 · starts 1:22:42 · 45 sec

Morano asks who is responsible for determining whether records were lost and when that determination will be completed; Smith-Cruz says agencies are responsible for developing policies but retention of Signal instant messages is not within current records management policy.

Frank Morano

So who's responsible, again, not to repeat what my two colleagues were saying, but who specifically is responsible for determining whether records were lost and when will that determination be completed?

Thank you for the question.

I would say in relation to the 2025 policy on instant messaging, it is the responsibility of agencies to develop and disseminate policies related to use of these materials.

However, the retention of these materials, specifically signal instant messaging, is not within policy for records management.
