Q&A

Chair Feliz asks about point-of-sale enforcement procedures

New York City Council · Sep 30, 2026 · starts 2:58:19 · 2 min 10 sec

Feliz asks about procedures for enforcing rules at point of sale, and Chief Obey describes the phased approach including education, inspections, and enforcement.

Oswald J. Feliz

Okay, and going back to the issue related to enforcement at the point of sale, can you talk to us about the procedures and operations to enforce the rules related or at the point of sale?

Oswald J. Feliz

I know this could be challenging, so just wondering what the procedures are.

Unidentified speaker

Not challenging at all.

Unidentified speaker

It's something that we've done since 2021.

Unidentified speaker

And again, phase one, we do this work in phases.

Unidentified speaker

At that time, the focus was on mopeds.

Unidentified speaker

We transitioned in 2026, January, to high-powered mopeds.

Unidentified speaker

And out-of-class e-bikes and e-scooters.

Unidentified speaker

So again, we do this work with the DOT.

Unidentified speaker

First, we tapped into local precincts, 78 of them citywide, to survey their commands and identify retailers that are selling these devices.

Unidentified speaker

So they came back to us with 71 retailers identified citywide selling these illegal devices.

Unidentified speaker

We reach out to the DOT.

Unidentified speaker

They do the educational outreach part of it, provide a flyer.

Unidentified speaker

That flyer is instrumental to us in the sense that we provide it to our officers just to help again with why we're here today, make that distinction between whether devices legal or non-street legal.

Unidentified speaker

It's helpful, just some of that language around it.

Unidentified speaker

And also, we also provided that to the retailer.

Unidentified speaker

So there has to be an education point.

Unidentified speaker

You have to give notice to these retailers.

Unidentified speaker

So after we do that with the flyers, then inspections, we start, and then enforcement.

Unidentified speaker

So those are the steps that we've taken.

Unidentified speaker

And again, like I mentioned, working again with the DOT.

Unidentified speaker

63 stores were inspected as of September 21.

Unidentified speaker

From those 63 retail stores, nine e-bikes were seized from three locations.

Unidentified speaker

And again, this is citywide.

Unidentified speaker

Nine old summonses were issued for motorized scooter noncompliance.

Unidentified speaker

57 criminal summonses were issued for other retail violations.

Unidentified speaker

For the most part, repeat, we go to the same locations.

Unidentified speaker

If we have to expand this, we'll do so.

Unidentified speaker

But again, we work hand-in-hand with the DOT on this.
