Wilson presses DCWP on lack of NYPD infraction reporting
Wilson notes DCWP does not receive direct reports of on-street infractions from NYPD or DEP, so it cannot enforce against bad actors. Ortiz says DCWP coordinates with police and parks but does not get adjudication outcomes, and Wilson suggests another agency may be better equipped.
But DCWP doesn't get the direct reports of infractions, right?
You said like DEP is called to some, NYPD is called to some.
That's correct, Councilmember.
The on-street enforcement is handled by the police department.
And in terms of the summons information, we don't receive it directly.
So do you speak with them?
Does NYPD report to you infractions that they've had?
Or how are you coordinating with the other agencies to enforce infractions?
Thank you for the question, Councilmember.
So we do coordinate with the police department and the parks department for on-street enforcement.
That includes providing them with regular updates about the licensed actors in the industry.
But they don't report to you.
They get a number of petty cab complaints or actions that they take.
They don't hand that information over to you.
We don't have the outcomes necessarily from those adjudications.
So there could be infractions that are being reported, but DCWP doesn't know what they are, so you can't do it.
You don't receive that information.
You can't enforce around bad actors.
So I think like...
That's one of the reasons that I think perhaps another agency is better equipped to keep this, you know, to really enforce among
bad actors that has that kind of enforcement ability on the ground.
Because I think...
You know, in my district, you know, we do, we get complaints all the time about particularly a lot of noise, like traffic infractions, where other agencies are being called.
But, you know, that's not getting back to your agency that issues the, you know, the permits for this.
Do you have, is there, if it were to remain at DCWP, how could you, you know, fill that gap?
What would be, like, could, how could we fix that?
Well, I think we want to continue building our ties with the community stakeholders to ensure that they understand the obligations they have.
Additionally, I think we want to work with PD in particular to facilitate a lot of the enforcement that's required for the unlicensed activity.
I actually don't think necessarily it's the license actors that are causing the problems in this industry.
I like, and we work closely with these folks too.
I know that they want to be compliant.
They're doing as much as they can to follow the rules.
I think it's really the unlicensed actors that are causing the biggest issues.
And I think we need to figure out some solutions for how we can bring better enforcement efforts against those.
Thank you.
