Caban asks how intersex discrimination cases are handled
Caban shares an example of a colleague who came out as intersex later in life and asks how CCHR handles such cases. Kamuf Ward says internal guidance already treats intersex discrimination as covered and cases go to the Office of Civil Rights Enforcement for factual interviews.
Thank you.
Yeah, it's interesting because I have a former colleague who is one of the most badass human rights lawyers,
an outspoken and very public advocate for the queer community and only came out as intersex a few years ago.
And you think about all of those things being true and what about the environment exists that creates the conditions where somebody like that, for example, doesn't come out until just now.
You've talked about this a little bit, but...
Somebody could call up with a complaint of gender discrimination, maybe not disclose that they're intersex.
But when you receive these cases, how do they get handled?
What's the CCHR's current legal guidance on the issue if you do learn?
Yeah, I mean, so our internal guidance is already that we would treat someone, if they were to call us and say, I think I've been
discriminated against in my workplace for being intersex, that could be being denied bathroom access, also in a public accommodation.
That would go to the Office of Civil Rights Enforcement, who would do a factual interview just like they do in any other circumstance.
