Nurse asks why disability testing fell while other tests grew

New York City Council · Oct 16, 2026 · starts 1:41:32 · 1 min 9 sec

Nurse asks why disability testing fell by a third while arrest record, credit history, and salary history testing grew. Rivera says the testing team is small and resources also support public-initiated complaints and strategic enforcement.

Sandy Nurse

Yeah, I think I'd be curious.

Sandy Nurse

I mean, because you're talking about the size of employers that might have that type of staffing or that size of an organization where you might have an EEO or an HR kind of department,

Sandy Nurse

but maybe where small businesses or two to three people working in a place might be needed.

Sandy Nurse

A question on why did disability testing fall by a third while tests on arrest record, credit history, and salary history each grew by half?

Stephanie Rivera

For testing in particular, thank you, Chair Nurse.

Stephanie Rivera

For testing in particular, we are, again, a very small team.

Stephanie Rivera

Some of those resources are also to support public-initiated complaints brought by members of the public, where we're trying to see if we can substantiate further their claims, and so that may divert resources as well.

Stephanie Rivera

We do have our new strategic enforcement unit that is also focusing on those broader impact cases and are starting to really rely on our testing team as well.
