Gennaro asks Camarda whether 561-A can be fixed
Gennaro asks whether opponents think 561-A can be amended or should be abandoned. Camarda says he does not think it is fixable and urges the Council to focus on due process, faster hearings, and more resources for DEP and OATH.
Thank you.
And as people testify, it would be important, and I think you were pretty clear that
I would be interested to know from everybody who testifies who has an issue with 561, whether they believe that...
That 561 is like resurrectable or just forget about the whole thing.
Because when you say oppose it, it means that, you know,
There was nothing we can really do to it to make it fair or better or whatever.
So I'm taking your testimony as just like an outright opposition to 561.
And those who believe that 561 with appropriate...
Amendments could be made into a bill that could work, you know, I would like to hear that as well.
It's fine to oppose it.
But if people have, and you did indicate some things that were problematic, so we'll take that into account.
But, you know, to the extent that people have testimonies, testimony that says, I got a problem with 561, and I think you need to do this, this, this, this, and this.
And in a way, your testimony touched on that.
But to the extent that people can be...
Explicit and say, you know, the current paradigm works, we like it, and we don't want it touched.
That's perfectly fine testimony.
And so, and, you know, to the extent that you have testimony that you want to submit after the fact about
what could be done about some of the problems that you mentioned.
We'll be happy to review it, but we certainly appreciate your testimony.
And again, I'm not talking just to you, but to everyone.
We're trying to make this as constructive a debate.
possible, you know, like we're trying to get 561 to work.
If you think it can never work, that's perfectly acceptable testimony.
And with that said, I'm going to go on to the next witness.
Did you have to come down from Albany to be here?
Go ahead, let me see.
Now, we're based in New York City.
We have staff in Albany as well.
Oh, okay.
All right.
Just in response to what you just raised.
I didn't actually ask a question, but I'll tell you what.
I'll tell you what.
It's just like, you know, I know we're going to have a long hearing, but you're the first witness, so you get the first witness prize.
And so why don't you...
Make a comment, you know, in response to what I just said.
So I'm asking you a formal question.
In relation to 561A, respectfully, I don't think it's fixable.
I think where the council should be focused is on due process.
I think there's agreement between the industry and the complainants and environmental groups and civic groups like Rain Van Albany.
That due process should be expedited.
I think everybody agrees with that.
Oath and DEP need more resources, as you talked about at the beginning.
And I think that's where everyone would agree.
We want to see complaints processed more quickly.
The industry deserves to get those complaints in a timely manner, and complainants will get paid faster, and you'll see a change in behavior.
Faster for those commercial vehicle companies that are getting complaints for the first time.
Thank you.
Please.
