Abreu asks BIC enforcement of side guard requirement
Abreu asks how BIC enforces the side guard requirement for trucks without waivers. Crotty describes yard and garage visits, joint Operation Safe Drive inspections with NYPD and state partners, 99% compliance, and fewer than 80 violations. Abreu requests violation and license revocation data.
And how does BIC enforce the side guard requirement for trucks that do not have a waiver?
We are regularly engaged in a variety of enforcement measures.
So we regularly visit the yards and garages of companies that we regulate.
And if we see a vehicle that looks like it should have a side guard and it does not, we will review and see was there an appropriate waiver here.
And if it was not, then that can result in a violation.
We do joint operations with NYPD, with the state, and with other agencies across the entire city.
Operation Safe Drive is what we call it, where we will pick a high-traffic corridor and we will pull over trucks and we'll do a full vehicle inspection to see, do they have a side guard if they need one?
Do they have a convex mirror?
Are they filling out their daily inspection safety reports?
So there's a lot of in-the-field work that we do to check, is this truck following all the safety regulations it's supposed to?
What is the number of violations, if you have any, for those?
For those who do not have a waiver and were found to not have a side guard.
That's data I would have to get back to you.
I would also need that information.
Do you know how many licenses have been revoked for those not having a side guard?
I may be wrong, Chair, but my understanding is...
One second.
We have 99% compliance with the side guard waiver.
So it would be very few where there have been violations of noncompliance with the side guard rule.
It's been less than 80 over the past several years.
We're talking about, again, 7,000 vehicles in the entire fleets that we oversee.
Since the side guard rule went into effect, there have been less than 80 violations.
So this demonstrates that the companies are either following the side guard rules.
And we are working with them when we need an alternative like a modified side guard or a waiver.
Thank you.
Thank you.
And I'll turn it over for questions for DOT.
