Chair Farías questions zero restraint reports and custody data
Farías asks how DOC aggregates restraint data and whether incidents involving other agencies are excluded. Chard explains custody transfers to NYPD or OCA and says reports are generated by the agency handling the person at the time.
So you folks have already stated that there's been, we have zero people that have been restrained in our custody, correct?
We've submitted no reports within the past three years.
So I just want to, I'm just trying to like understand.
How we're aggregating data around some of these things.
So let's say an inmate, someone that's incarcerated, not pregnant, just someone that's incarcerated, needs medical care, leaves DOC custody with NYPD to a hospital to receive a medical procedure.
Is that what happens when someone needs a medical procedure?
No.
When someone is in our care and in our custody, they remain in our custody throughout.
DOC officers would be providing that escort.
So in the case where, I guess what I'm trying to figure out is,
We understand from a case that we know of where someone was restrained or had restraints.
They were technically in NYPD's custody, but they were still someone that was incarcerated.
Correct.
I can't speak to an individual case.
I'm not sure what's being referenced, but I do, you know, if you are, if we're discussing someone who's coming in pre-arrangement, there's custody transfers that occur throughout that.
Once someone has been remanded into DOC's custody, our staff are the ones that are transporting and maintaining custody of that individual.
